In a landmark ruling, the Supreme Court has struck down domicile-based reservation for postgraduate medical courses, declaring it violative of Article 14 of the Constitution. This decision ensures that admissions to PG medical courses under state quotas will now be based solely on merit, specifically National Eligibility cum Entrance Test (NEET) scores, rather than a candidate’s state of residence.
The bench, consisting of Justice Hrishikesh Roy, Justice Sudhanshu Dhulia, and Justice SVN Bhatti, emphasized the principle of equality under the Constitution. "As citizens and residents of India, we have the right to choose residence anywhere… the Constitution also gives us the right to choose admission in educational institutions across India," Justice Roy stated. The court clarified that there is no such thing as a "provincial or state domicile," asserting that all Indians are entitled to live and work anywhere in the country, including in educational institutions.
The court recognized that reservations could be justified for undergraduate courses to address local educational disparities. However, it concluded that reserving seats for postgraduate courses based on domicile is unconstitutional, as it violates the right to equality and merit-based access to education.
